Judge axes case in football melee - Salt Lake Tribune

}
A justice have dismissed an assault complaint against a adult male accused of leaving the outs of-bounds to assail a football game participant during a scrimmage last twelvemonth at American Pitchfork High School. But public prosecutors said Thursday they will appeal the dismissal, claiming 4th District Judge Leslie Howard Maetani's opinion was legally and procedurally flawed. William Carlos Williams Ted Shawn Asiata, 19, was charged with one count of simple assault, a social class Type B misdemeanor, for allegedly kicking a helmeted American Pitchfork participant twice in the caput after a fighting erupted among participants during a Nov. Two game between American Pitchfork and Hunter High schools. The justice dismissed the lawsuit Wednesday, saying public prosecutors had failed to follow with his order to supply the defence with original videotapes of the fracas. Defense lawyer Brett C. Sherwood Anderson said during an interview that he needed to see the original video, shot by fans and squad members, to do certain it had not been altered. He also wanted the name calling and computer addresses of the people who shot the video. Prosecutor Kasey Willard Huntington Wright countered that he did not have got the original material, which had been provided to patrol in assorted forms. Willard Huntington Wright said he had, however, provided the defence with everything he had, even adoption a photographic photographic camera from a fan so Sherwood Anderson could watch the footage on the camera's monitor. Willard Huntington Wright claimed the judge, who never saw any of the video, Advertisement

should not have got ruled without holding a hearing to measure the grounds first. Furthermore, if the justice deemed the picture footage unacceptable, he could have got suppressed that grounds rather than dismissing the full case, said Wright, who bes after to appeal the opinion to the Beehive State Court of Appeals. Sherwood Anderson said Asiata denies fighting with anyone during the melee. But Willard Huntington Wright said the picture - some of which was posted on YouTube - "clearly demoes the suspect kicking an American Pitchfork participant in the caput twice." - Sir Leslie Stephen Hunt
